NYPD & CIA conduct a massive surveillance program to monitor Muslim communities

The NYPD has been conducting an extensive covert surveillance program on the Muslim Community in New York and New Jersey. The AP report on the spy program: “The [NYPD] has dispatched teams of undercover officers, known as ‘rakers,’ into minority neighborhoods as part of a human mapping program, according to officials directly involved in the program. They’ve monitored daily life in bookstores, bars, cafes and nightclubs. Police have also used informants, known as ‘mosque crawlers,’ to monitor sermons, even when there’s no evidence of wrongdoing. NYPD officials have scrutinized imams and gathered intelligence on cab drivers and food cart vendors, jobs often done by Muslims. Many of these operations were built with help from the CIA, which is prohibited from spying on Americans but was instrumental in transforming the NYPD’s intelligence unit.”

So the CIA has decided to circumvent Federal Law by having the NYPD do their dirty work. Was the White House aware of this program, was Mayor Bloomberg? We have a lot more yet to learn about this story.

Is it legal to record a phone call?

Is it legal to tape record a phone call without consent or permission?

There are complex issues of law that must be addressed before deciding whether recording a phone call is legal. At both the Federal and State level, there are specific laws that determine the permissibility of using electronic recording equipment.

It is absolutely essential to know your rights when recording audio and utilizing electronic recording equipment.

PLEASE NOTE: Illegally using audio recording equipment can give rise to criminal prosecution as well as civil suits by the injured party.

Most statues that govern these issues are primarily concerned with wiretapping and eavesdropping, however the statutes usually to electronic recordings of conversations as well, whether in-person or over the phone.

Federal Law: Federal statutes permit recording of phone calls and electronic communications with the consent of at least one party to the call. The majority of states have wiretapping statutes that are based on federal law and most have extended the state statutes to cover in-person conversations.

General Rule: It is nearly always illegal to record a conversation when you aren’t a party, don’t have consent to tape and could not naturally overhear the conversation.

One-Party Consent Statutes: Washington D.C. and thirty eight states allow the recording of conversations when the recorder is a party WITHOUT the recorder informing the other parties that they are being recorded. So in these states, as long as you are a party to the conversation, it is legal to record it. Nevada also has a one-party consent law, although the state Supreme Court has ruled it an all-party rule and therefore illegal.

All-Party Consent Statutes: Twelve states require, under most circumstances, the permission of every party to a conversation. These jurisdictions are the following: California, Connecticut, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Pennsylvania and Washington. In these states you will need the consent of EVERY single party involved in the conversation before taping.

In addition to recording, Federal and most state laws forbid disclosing the contents of any illegal recorded call or communication.

Is it Legal to use Hidden Cameras?

Recording video with Hidden Cameras is almost always permissible however, at least twenty four states have statutes which forbid using hidden cameras in especially private places, for instance in places with nudity such as a bathroom.  Many of these laws forbid unattended hidden cameras placed in a location, not cameras hidden on a person. The audio portion of a hidden camera recording is treated like any audio recording and the laws mentioned above apply. In general, if you are recording using unattended hidden cameras in a private place, please use caution.

Ex-Scientologist confesses to being a spy at California Board of Supervisors

Paulien Lombard, an ex-scientologist, admitted on Tuesday to having worked as a spy for the Church of Scientology. Her holy spy mission had been to target members of the hacking collective Anonymous. Anonymous began protesting the Church of Scientology in 2008, after the Church had attempted to censor an unflattering video interview with Tom Cruise which leaked to the Internet.  Lombard admitted to her spying past before the Riverside County, California Board of Supervisors who have been recently discussing denouncing Anonymous  as a hate group because of a Scientology sympathetic supervisor.

MIT Lab’s Social X-Ray Specs allow wearer to see another’s emotions

M.I.T.’s Media Lab has designed glasses that allow the wearer to pick up on subtle social cues that ordinary people can rarely recognize. Apparently, companies are already looking to rig up their sales teams with these glasses. Seems like this might be a tad invasive for a salesman to be using (or some lecher trying to pick up women in a bar), but it could certainly be a big help to those with autism….or to a spy.

Israeli travelers want apology from New Zealand for Spy accusations

The young Israeli Backpackers accused this week by New Zealand of being spies for the Mossad want an official Kiwi apology. After narrowly escaping death in the Christchurch earthquake, and losing one of their childhood friends in the destruction, the three Israelis were held in New Zealand on spy accusations.
The three young men, now back in Israel, have returned to their jobs: Guy Jordan is a welder, and the other two backpackers work in an olive grove of a kibbutz. They work in an olive grove…of a Kibbutz! Very very suspicious, great work New Zealand!

This whole story begs the question, why in the world would anybody need to spy on New Zealand? and the Mossad? I wouldn’t imagine New Zealand is very high on even the most conservative Mossad threat list!

Judge rules it acceptable for company to continue spying on customers through their webcams

A judge has ruled against an injunction barring computer rental company, Aarons, from spying on it’s customers using malware which controls webcams.

Aarons, which rents out computers to its customers, has been using software that transmits images and communications(including customers’ bank account details!) on the rental computers back to the Aarons’ offices. The judge based his ruling on the fact that the Aarons employee who had provided the evidence of the webcam spying was no longer employed by Aarons, and therefore that the evidence didn’t constitute proof of likely future harm.

This is yet another blow against the bustling computer rental industry!

Iran claims to have shot down U.S. Spy Plane collecting Intel on nuclear sites

Iran TV is reporting that the Revolutionary Guards have shot down an unmanned U.S. Spy Drone Plane that was allegedly gathering intelligence on Iranian Nuclear efforts.
As always it’s complicated parsing the news coming out of Iran. Did this actually occur? Is this a warning shot to the U.S. and Israel to stay away? Is this merely an effort to shore up domestic support for the current regime?

An Iranian lawmaker says Iran’s Revolutionary Guard has shot down an unmanned U.S. spy plane that was attempting to collect information about an underground uranium enrichment site.

Iran’s state TV-run Youth Journalists Club on Wednesday quotes MP Ali Aghazedah Dafsari as saying the elite military group shot down the aircraft as it was flying near the Fordu site around the holy city of Qom. The report did not say when the Revolutionary Guards shot down the plane. There has been no comment from U.S. officials.

The report comes a day after Iran said it was installing new centrifuges aimed at speeding up its enrichment of nuclear material.

Foreign Ministry spokesman Ramin Mehmanparast said Tuesday the new equipment will bring more speed and better quality to the process.

He also reiterated that Iran’s nuclear program is for peaceful purposes.

The United States and other Western countries believe Iran is enriching uranium to develop nuclear weapons.

The United States, European Union and the United Nations all have imposed sanctions on Iran for refusing to suspend its enrichment of uranium, a process that can be used for civilian and military purposes.

D.C. Businessman arrested on suspicions of working as a Spy for Pakistan

A Washington D.C. businessman was arrested today for allegedly working as a spy for Pakistan’s spy agency, ISI. This is occurring at a time when both the U.S. and Pakistan have been viewing each other with increasing suspicion.

This begs the question, how many other countries currently have a spy working as a businessman in Washington, D.C.? And also, how often does the CIA turn a blind eye to foreign covert activities?

Federal authorities have arrested a Washington businessman for allegedly working on behalf of Pakistan’s spy agency, sources familiar with the case told Fox News.
Search warrants were executed earlier Tuesday at the suspect’s office in Washington, D.C., and at his home in suburban Virginia. It is believed that he has ties to the Pakistan’s Inter-Services Intelligence, or ISI, and was acting in the United States as an unregistered foreign agent, a federal crime in the United States.
The nature of the suspect’s business and interactions with the U.S. government is unclear, but it is believed he was trying to help the ISI. He is set to appear in court Tuesday afternoon in northern Virginia.
The case could further strain U.S.-Pakistan relations, which have been particularly rocky following the raid on Usama bin Laden’s compound in May.
In addition, some say parts of the ISI have been aiding a terror group active in the region, Lashkar-e-Taiba, which was responsible for the 2008 Mumbai, India, attacks. More recently, there has been speculation the group may have had a hand in last week’s bombings in Mumbai that left 21 dead.
